Terms of Service
These Terms of Service (“Terms”) govern access to and use of the QLA Question Level Analysis web application, its public website, generated reports, documentation and related services (together, “QLA” or the “Service”). QLA is developed and maintained by Kai Young.
1. Acceptance of these Terms
By creating an account, accepting an invitation, or otherwise using QLA, you agree to these Terms. New account registrations record the version of the Terms accepted and the date of acceptance. If you use QLA on behalf of a school, college, trust, department or other organisation, you confirm that you are authorised to use the Service in that context.
2. What QLA provides
QLA can be used through an individual teacher workspace, a tutor workspace, or an institutional school workspace. Individual and tutor users do not need to configure a school, department or class before analysing an assessment. Personal work can remain separate if the same account later joins a school.
QLA provides tools for question-level assessment analysis, including school, department and class organisation; academic-year and year-group filtering; exam/question-set organisation; mark entry; percentages and comparative colour indicators; predicted values; teacher feedback; XLSX workflows; DOCX reports; and controlled sharing of question sets and reports.
2A. Student reports and educational contact details
Authorised users may optionally associate a student email address with a class or teaching record so that QLA feedback can be delivered to that address. The school, tutor or other authorised user is responsible for ensuring that the address is appropriate for educational communication and that they have a lawful basis and any required permission to use it. QLA may record delivery status for auditing and troubleshooting.
QLA may calculate topic and Assessment Objective trends across multiple assessments to identify repeated strengths, weaknesses and learner outcomes. These analytics are educational decision-support information and should be interpreted by a qualified educator rather than treated as an automated final judgement about a learner.
3. Accounts, roles and permissions
Account holders must keep credentials secure and must not share accounts. School and department administrators are responsible for granting appropriate access. Department membership does not necessarily provide access to every class: QLA can apply separate Read, Write, Create, Manage, Share and Reports permissions to individual classes. Users must not attempt to bypass those controls or access information for which they have not been authorised.
4. Student and assessment data
Schools and authorised users are responsible for ensuring they have a lawful basis and appropriate authority to enter, store and process student and assessment information in QLA. Only information necessary for the intended educational purpose should be entered. When a question set is shared between classes, student rosters, marks, predictions and teacher notes are intended to remain scoped to the relevant class unless separately and deliberately shared.
5. User responsibilities
- Check marks, maximum marks, predicted values, calculations and generated feedback before relying on them.
- Maintain appropriate confidentiality around student and staff information.
- Follow your institution’s data-protection, retention, safeguarding and acceptable-use policies.
- Use appropriately secured devices, accounts and server infrastructure.
- Report suspected security issues responsibly.
6. Acceptable use
You must not use QLA unlawfully; interfere with or deliberately degrade the Service; attempt unauthorised access; bypass permissions; introduce malicious code; scrape or automate the Service in a way that materially affects availability; or use QLA to infringe the rights of another person. Reasonable technical limits may be applied to protect stability and security.
7. Hosted service and availability
QLA is provided as a hosted web application. We may maintain, update, secure or temporarily restrict the service where reasonably necessary for reliability, security or development. We aim to keep QLA available but do not promise uninterrupted or error-free access.
8. Hosted services, plans and future features
QLA may support account levels, school plans, feature flags or future Pro functionality. Database or interface support for a feature does not mean that feature has been purchased or is currently available. Where paid or hosted services are offered, any additional pricing, billing, service-level or data-processing terms will be presented separately.
9. Reports and share links
DOCX, XLSX and web-based reports are generated from data supplied by authorised users. Users are responsible for reviewing report content before distribution. Report share links should be treated as confidential. Where expiry or revocation controls are available, users should select settings appropriate to the sensitivity of the information being shared.
10. Intellectual property
QLA software, branding, documentation, original interface elements and other original materials are owned by or licensed to Kai Young unless stated otherwise. Except where permitted by law or by an express licence, you may not sell, redistribute, decompile, circumvent technical protection measures, or create an unauthorised competing copy of protected parts of the Service.
11. Third-party software and services
QLA may rely on third-party software, hosting platforms or document formats. Those components may be subject to their own licences and terms. References or links to third-party services do not make QLA responsible for those services.
12. Availability, maintenance and changes
We aim to keep QLA reliable and secure, but uninterrupted or error-free availability is not guaranteed. The Service may be changed, upgraded, suspended or maintained for operational or security reasons. Where reasonably practicable, material changes affecting a hosted service or these Terms will be communicated to affected users or administrators.
13. Suspension and termination
Access may be suspended or terminated where reasonably necessary because of a serious breach of these Terms, unlawful use, security risk, misuse of other users’ data, or non-payment of an agreed paid service. A school or individual user may stop using QLA subject to any applicable subscription, retention or separate service agreement.
14. Disclaimers
QLA is an analytical aid and is not a student information system, safeguarding system, awarding body, statutory assessment authority, or substitute for professional educational judgement. To the maximum extent permitted by law, the Service is provided on an “as available” basis and no guarantee is made that every calculation, report, integration or output will be suitable for every purpose.
15. Limitation of liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Subject to applicable law and any separate paid-service agreement, QLA and its developer are not responsible for indirect or consequential loss, lost profit, lost goodwill, or losses outside our reasonable control.
16. Privacy and data protection
Use of personal data is addressed further in the Privacy Policy. A school using QLA remains responsible for determining its own legal obligations, retention rules, privacy notices and data-processing arrangements.
17. Changes to these Terms
These Terms may be updated when QLA or its service model changes. The version and effective date shown above identify the applicable published version. Where a future change requires renewed acceptance, QLA may ask users to accept the updated Terms before continuing.
18. Governing law
These Terms are governed by the laws of England and Wales. Subject to any mandatory rights that apply, the courts of England and Wales will have jurisdiction.
